1. Acceptance of Terms

By accessing or using the Pullstorm TCG website (pullstormtcg.com.au) or placing an order with us, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, users, and customers.

2. Products — Sealed Collectibles

All products sold by Pullstorm TCG are factory sealed trading card game products. By purchasing, you acknowledge and agree to the following:

• We sell sealed products only. We make no representations, warranties, or guarantees regarding the contents of any sealed booster pack, box, or collection.
• The specific cards contained within sealed products are determined randomly by the manufacturer (The Pokémon Company, Bandai, Konami, Wizards of the Coast, etc.). We have no control over card distribution or pull rates.
• Product images are for illustrative purposes only. Actual packaging may vary slightly depending on print run or region.
• We do not guarantee that any specific card, rare, or hit will be found in any product purchased.
• The market value and collectible value of trading card products can fluctuate significantly. Past performance is not indicative of future value. We make no investment representations.

3. Authenticity Guarantee

We guarantee that all products sold are genuine, officially licensed, factory sealed products sourced from authorised distributors or reputable wholesale channels. If you receive a product that you believe is not genuine, contact us immediately at contact@pullstormtcg.com.au and we will investigate and resolve the issue.

4. Pricing & Payment

• All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable.
• We reserve the right to change prices at any time without prior notice. Price changes will not affect orders already confirmed.
• In the event of a pricing error, we reserve the right to cancel the order and issue a full refund. We will notify you promptly if this occurs.
• Payment is processed securely through Stripe, PayPal, or Afterpay. By completing a purchase, you authorise the relevant payment provider to charge the total amount shown at checkout.
• Orders are not confirmed until payment is successfully processed.

5. Shipping & Delivery

• We ship Australia-wide. Delivery timeframes are estimates only and are not guaranteed.
• We are not responsible for delays caused by third-party carriers, Australia Post, customs processing, natural disasters, or any event outside our reasonable control.
• Risk of loss and title for products pass to you upon dispatch. Once a parcel is handed to the carrier, responsibility for transit lies with the carrier.
• You are responsible for providing a correct and complete delivery address. We are not liable for orders lost or delayed due to an incorrect address provided by the customer.
• If a parcel is lost in transit, we will work with you and the carrier to investigate. Resolution timelines depend on the carrier's investigation process.

6. Returns & Refunds

• Sealed products: Returns are accepted at our discretion provided the product is in its original, factory sealed, unopened condition. Return shipping costs are the responsibility of the customer unless the product is faulty or incorrectly described.
• Opened products: We do not accept returns or offer refunds on opened sealed products. Once a product is opened, it is considered used and the contents are no longer our responsibility.
• Damaged in transit: If your order arrives damaged, please contact us within 7 days of delivery with photos of the packaging and product. We will assess each case and offer an appropriate remedy including replacement, store credit, or refund.
• Change of mind: Change of mind returns may be accepted on sealed, unopened products at our discretion. Return postage is at the customer's expense.
• Refunds, where approved, will be processed to the original payment method within 5–10 business days.

Nothing in this policy limits your rights under the Australian Consumer Law (ACL). Our products come with consumer guarantees that cannot be excluded.

7. Stock Availability

Stock levels displayed on our website are updated regularly but may not reflect real-time availability, particularly during high-demand periods. In the rare event that a product becomes unavailable after your order is placed, we will contact you to offer a full refund or suitable alternative. We do not guarantee the availability of any product.

8. Limitation of Liability

To the maximum extent permitted by law:

• Pullstorm TCG is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or products.
• We are not liable for any loss of profit, loss of collectible value, or financial loss resulting from the purchase or resale of any product.
• Our total liability to you in connection with any order shall not exceed the amount paid for that order.
• We are not responsible for the actions, content, or policies of third-party payment providers, shipping carriers, or linked websites.

9. Intellectual Property

Pokémon and all associated names, characters, and trademarks are the property of Nintendo, Creatures Inc., and GAME FREAK Inc. One Piece and related marks are the property of Bandai. Yu-Gi-Oh! is the property of Konami. Magic: The Gathering is the property of Wizards of the Coast. Pullstorm TCG is an independent retailer and is not affiliated with, endorsed by, or sponsored by any of these companies. All product images and brand marks used on this site are for identification purposes only.

10. Prohibited Use

You agree not to:

• Use our website for any unlawful purpose.
• Attempt to gain unauthorised access to any part of our website or systems.
• Submit false or fraudulent orders or payment information.
• Use bots, scrapers, or automated tools to access our website without permission.
• Resell products purchased at a loss to artificially manipulate market pricing.

We reserve the right to cancel any order and refuse service to any customer at our discretion, including but not limited to cases of suspected fraud, chargebacks, or abuse.

11. Australian Consumer Law

Our products come with guarantees under the Australian Consumer Law that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms of Service is intended to exclude, restrict, or modify rights you have under the ACL.

12. Governing Law

These Terms of Service are governed by the laws of Australia. Any disputes arising from your use of our website or purchase of our products will be subject to the exclusive jurisdiction of the courts of Australia.

13. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our website after any changes constitutes your acceptance of the revised terms.
